Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of BellAveGo (the "Service"), operated by BellAveGo ("BellAveGo," "we," "us"). By creating an account, accessing the Service, or paying for a subscription, you ("Customer," "you") agree to these Terms.

If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. What we provide

BellAveGo is a homeowner lead-generation service for home-service contractors. The Service includes:

  • A recurring weekly delivery of homeowner leads in your service area, sourced from public records (building permits, property transfers, verified storm events, new-homeowner records) and licensed property-data providers
  • Lead details such as homeowner name, street address, skip-traced phone number, property attributes, and the signal that surfaced the lead
  • An AI-written outreach script (SMS, email, and call opener) for each delivered lead
  • Optional AI-assisted outreach that contacts your delivered leads on your behalf, in your business name, with your authorization
  • A dashboard showing your delivered leads, outreach status, and account settings

Some grandfathered accounts retain legacy call-answering and reporting features; those features are governed by these same Terms.

3. Subscription, billing, and free trial

Tiers + pricing: current pricing is published at bellavego.com/pricing. We may change pricing for new subscriptions at any time; existing subscriptions are grandfathered until renewal.

Billing cycle: you choose weekly or monthly at checkout, billed in advance via Stripe. Weekly bills every 7 days; monthly bills every month. Annual plans, where offered, receive the discount shown at the time. Weekly is a payment-plan option and costs more over a year than paying monthly — we state this plainly rather than presenting it as a discount.

3-day free trial: every new subscription starts with a 3-day free trial. We collect a payment method at signup but do not charge it during the trial. If you cancel before the trial ends — for any reason — you are never charged. Your first charge occurs on day 4 unless you cancel first. Subscriptions created before 2026-08-02 started with a 7-day trial and were charged on day 8; those terms continue to apply to them.

Trial lead volume: during the free trial we deliver 5 leads so you can evaluate real records in your zip. Once your first payment clears, delivery moves to 10 leads per week.

No results guarantee: we deliver exclusive homeowner leads sourced from public records. We do not guarantee that any lead will answer, respond, hire you, or result in a booked job — those outcomes depend on your own outreach, pricing, and service. No refunds are offered on the basis of results. Your protection is the 3-day free trial: use it to evaluate the leads before any charge, and cancel in one click if they are not right for you.

Legacy 1-Job Guarantee (closed to new customers 2026-07-31): subscriptions created before 2026-07-31 remain covered by the 1-Job Guarantee in effect at the time they signed up — if they did not book at least one paying job from their leads within 30 days of their first paid charge, they may contact us within 14 days after that window for a refund of that first monthly charge, a free next month if they stay, and they keep every lead delivered. It applies once per customer, to the first paid month only, and requires that they contacted at least 5 delivered leads during the period (we may verify outreach activity in the dashboard). This guarantee is not available on subscriptions created on or after 2026-07-31.

Cancellation: you may cancel anytime from your dashboard or by contacting us — one click, no phone call, no retention process. If you cancel during the trial, you are not charged. After your first paid charge, service continues through the end of the paid period and no further charges apply. Except under the legacy guarantee above (where it still applies), no refunds are issued for any already-billed period — including partial months. Cancel before the next renewal to avoid the next charge.

Loss of access and territory on cancellation: we sell one cleaning company per zip code and trade. When you cancel, access to leads already delivered to you ends, and after a short grace period your zip code is released and may be claimed by another company. If it is claimed, we cannot guarantee it will be available to you again.

Failed payments: if a payment fails, we will retry for 7 days and notify you. After 7 days the service will be suspended (lead delivery and outreach pause). After 30 days of non-payment, the account may be cancelled and data subject to the deletion schedule in our Privacy Policy.

Installment collection (subscriptions created on or after 2026-08-04): if a subscription payment fails, you authorize us to collect the amount owed in smaller installments charged to your saved payment method over the following weeks, until the failed amount is fully collected. Installments never total more than the amount you already owed, are limited to a reasonable number of charge attempts, and stop immediately if you cancel or the amount is otherwise paid. This applies to both weekly and monthly plans. If you would rather pay the failed amount in one charge or update your card instead, contact us and we will arrange it.

4. Your responsibilities

You agree to:

  • Provide accurate account, business, and billing information
  • Hold any licenses or registrations your trade and jurisdiction require to perform the work you market to leads
  • Comply with all applicable laws when contacting leads — including the TCPA, state telemarketing laws, Do-Not-Call rules, and carrier messaging rules — whether you contact them yourself or authorize the Service to send outreach on your behalf (BellAveGo handles A2P 10DLC registration at the platform level; you are responsible for your own contact and consent practices)
  • Honor opt-out requests from any homeowner promptly and permanently
  • Not use the Service or lead data to harass, defraud, or impersonate any person
  • Not resell, redistribute, or share lead data outside your business
  • Not attempt to reverse-engineer, scrape, or resell the Service without our written permission

You are the caller. BellAveGo delivers contact data compiled from public records and licensed providers. We do not place calls or send text messages to homeowners on your behalf unless you expressly enable an outreach feature and supply the message. When you contact a lead, you are the business initiating that call or text and you — not BellAveGo — are the “seller” and “telemarketer” for purposes of the TCPA, the FTC Telemarketing Sales Rule, the National Do Not Call Registry, and any state equivalent (including, for example, the Florida Telephone Solicitation Act).

No Do-Not-Call warranty. Phone numbers delivered through the Service are not represented as scrubbed against the National Do Not Call Registry, any state DNC list, or any litigator or wireless-identification list, unless a lead is expressly labeled as scrubbed in your dashboard. You are responsible for performing your own DNC scrubbing and for maintaining your own internal do-not-call list and written DNC policy. We strongly recommend manually dialing rather than sending bulk text messages, since marketing text messages to mobile numbers generally require prior express written consent that the Service does not obtain for you.

Indemnity for your outreach. You agree to indemnify and hold harmless BellAveGo, its owner, and its affiliates from any claim, penalty, fine, judgment, settlement, or legal expense arising from how you contact leads — including claims under the TCPA, the Telemarketing Sales Rule, Do-Not-Call rules, state telemarketing statutes, or carrier messaging policies.

5. Lead data + AI outreach — important

Leads are compiled from public records and licensed third-party property-data providers. We make commercially reasonable efforts to verify lead details (including skip-traced phone numbers), but we do not guarantee that every lead is accurate, current, reachable, or interested in hiring you. A lead is an introduction to a homeowner showing a relevant signal — not a confirmed job.

Leads delivered to your account are generated for your business; we do not resell the same delivered lead to another BellAveGo customer.

If you enable AI-assisted outreach, messages are sent in your business name only with your authorization, and you remain responsible for the content and legality of that outreach as described in Section 4. You can review scripts and disable outreach at any time from your dashboard.

AI-generated outputs (outreach scripts, follow-up text, recommendations) are suggestions, not guaranteed results. Review them before acting.

6. Service availability

We target 99.5% uptime but do not guarantee continuous, uninterrupted access. Scheduled maintenance is announced in advance when feasible. We rely on third-party infrastructure (Twilio, Anthropic, Stripe, Supabase, Vercel, and licensed property-data providers) and are not liable for outages caused by those providers, though we will make commercially reasonable efforts to restore service. Public-record sources (municipal permit systems, government data feeds) can lag or go offline; weekly lead delivery may shift by a short period in those cases.

7. Intellectual property

BellAveGo retains all rights, title, and interest in the Service, software, AI models, prompts, and dashboards. You retain ownership of your business data, call recordings, customer information, and any content you upload. We use your data only as described in our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUT.

Except as expressly provided by the guarantees in Section 3, we do not guarantee that any lead will respond, convert into a booked job, or generate any specific amount of revenue. ROI projections on our marketing pages are estimates based on typical home-service businesses, not promises specific to your shop.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLAVEGO'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST BUSINESS OPPORTUNITIES.

10. Indemnification

You agree to indemnify and hold harmless BellAveGo from any claims, damages, or costs (including reasonable attorneys' fees) arising from your use of the Service in violation of these Terms or applicable law, including claims by your customers related to your business practices.

11. Termination

Either party may terminate this agreement at any time. You can cancel via your dashboard. We may terminate or suspend your access for material breach of these Terms, non-payment, fraudulent activity, or to comply with legal obligations. On termination, your data is subject to the retention + deletion schedule in our Privacy Policy.

12. Governing law + disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. You and BellAveGo each waive any right to a jury trial.

Individual arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Cook County, Illinois, rather than in court. BellAveGo will pay the arbitration filing and arbitrator fees for claims under $10,000. Either party may instead bring an individual claim in small-claims court if it qualifies. Either party may seek injunctive relief in court for misuse of intellectual property or confidential information.

Class-action waiver. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding, and may award relief only in favor of the individual party seeking relief. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in the courts located in Cook County, Illinois.

Your right to opt out. You may reject this arbitration and class-waiver provision by emailing bellavegollc@gmail.com with "ARBITRATION OPT-OUT" in the subject line within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms and will not affect your service in any way.

Once BellAveGo's LLC formation in Delaware completes, jurisdiction may shift to Delaware; we'll notify active customers at that time.

13. Changes to these Terms

We may update these Terms. Material changes are emailed to all active customers at least 30 days in advance and posted with a new "Last updated" date here. Continued use of the Service after changes take effect constitutes acceptance.
